Terms & Conditions
Set out below are our ‘Terms and Conditions’ by which ‘Mono Industries’ agrees to provide internet hosting and/or domain registration services [Services] to you the ‘Customer’. It constitutes the Terms and Conditions on which the ‘Customer’ agrees to be bound.
Mono Industries reserve the right to amend and update these Terms and Conditions at any time without notice.
Hosting services
Server use
1.
Our web hosting accounts are to
be used by the primary owner only.
Web hosting account holders are not permitted to re-sell, store or give away the web hosting Services of their web site to other parties.
Web hosting Services are defined as allowing a separate, third party to host content on the owner’s web site. Exceptions to this include ad banners, classified ads and personal ads.
2. Mono Industries reserve the right to refuse service and/or access to its servers to anyone at any time.

Mono Industries do not allow any
of the following content to be stored on its servers:
[i] Illegal Material
: This includes copyrighted works,
commercial audio, video, or music files, and any material in violation of any international, national or local law or regulation.
[ii] Adult Material:
Includes all pornography, erotic
images, or otherwise lewd or obscene content. The designation of “adult
material” is left entirely to the
discretion of Mono Industries.
[iii] Warez:
Includes pirated software, ROMS,
emulators, phreaking, phishing,
hacking, password cracking, IP
spoofing etc., and encrypting of any of the above. Also includes any sites which provide “links to” or “how to” information about such material.
4. You may not store more data in your account than your allotted virtual server space.
5. Your virtual server [inc. FTP and Telnet access] is for your personal use only. You must not divulge the password to any other person and you should take reasonable precautions to ensure that it is not discovered by other people.
6. Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent back-up of all data stored on your virtual server.
7. You may not run server processes [eg. talkers/IRC Bots] from your virtual server.
8. We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of Services.
9. When your account is closed, all files [including web pages, etc.] will be deleted.
10. We reserve the right to cancel your account at any time without notice.
11. Users must not participate in any form of un-solicited bulk e-mailing or spam.
12. By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.
Web pages
1. Commercial use of web and FTP space is permitted.
2. You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages does not violate UK law.
3. You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page[s].
4. We reserve the right to remove material deemed inappropriate from your web pages, without prior notice.
Restrictions on software use
1. Telnet shell accounts are made available for editing and setting up your web site. It is not a development platform for issues unrelated to your web site.
2. You must not leave your home directory at any time.
3. You must not attempt to gain the privileges of another user.
4. Interfering with the following files will result in your telnet access being removed - .bash_history - .bash_logout - .bash_profile - .bashrc.
Bandwidth
1. If your bandwidth reaches a point where it has an adverse affect on other clients, we reserve the right to disable your site until you can reduce your bandwidth usage.
2. Each virtual server includes a nominated amount of bandwidth of 25Gb per month. If you use more than this amount, then you agree to pay for this bandwidth at a rate of 10p [ten pence] per 1Mb. You can set an alert on your account so you will know if you get close to this amount.
Domain name registration
1.
Mono Industries will consider all requests for domain name registration and accept or reject them in
accordance with guidelines set by
the relevant naming authorities:
[i]
.uk domain registrations must abide
by http://www.nic.uk/terms.html
[ii]
Global domain registrations must
abide by INWW terms.
2. Upon acceptance of registration requests Mono Industries will submit names for registration and make full registration upon receipt of payment.
3. Once a domain name has been submitted for registration no refunds will be made by Mono Industries.
4. Mono Industries reserve the right to halt the registration or transfer/release of a domain name if outstanding monies are owed to them by the registrant.
5. Mono Industries process domain registration requests on a first come, first served basis. Until the registrant receives confirmation from Mono Industries that the name has been submitted for registration, there is no guarantee that the domain name requested has been registered.
6. Mono Industries may cancel or halt domain name registrations under certain circumstances. One of these is if the completion of the registration puts Mono Industries in conflict with guidelines set by the relevant naming authority.
7. Mono Industries do not accept any responsibility for the use of registered domain names, especially where there may be conflict over rights to ownership.
8. The registrant agrees that all details submitted in respect of a domain name registration are true and correct.
9. In the event of a domain dispute the registrant must be able to demonstrate that the registration of a domain name and the way in which it is used [directly or indirectly] does not infringe the legal rights of any third party.
10. The registrant indemnifies Mono Industries from any legal proceedings and costs that arise as a result of the registration of a domain name.
11. Data submitted by the registrant pertaining to the registration of a domain name will not be made available to other organisations and members of the public, apart from that made public by the relevant naming authority.
12. Mono Industries reserve the right to make alterations to the Terms and Conditions of domain name registration at any time.
13. Transfers and renewals of domain names will be made under the Mono Industries Terms and Conditions of domain name registration in force at the time of renewal or transfer.
14. These Terms and Conditions constitute the entire agreement between Mono Industries and the registrant of the domain name. These Terms and Conditions replace all prior agreements whether verbal or in written form.
15. Should Mono Industries cease trading, domain renewals must be carried out through the relevant naming authority and all forwarding settings must be transferred by the registrant to a new provider.
Payment
1. Payment for Hosting and/or domain name registration Services is made annually in advance.
2. If you cancel your account at any time within the agreed period, then Mono Industries will not make any refunds on any unused portions of your account.
Credit
1. If your account/service is activated before payment is made, then payment must be sent in full by return.
2. If payment is not made in full within 28 days your account may be deactivated.
Indemnification
1. The hosting Customer agrees that it shall defend, indemnify, save and hold Mono Industries harmless from any and all demands, liabilities, losses, costs and claims, including legal fees asserted against Mono Industries, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed.
2.
The hosting Customer agrees to defend, indemnify and hold harmless Mono Industries against liabilities
arising out of:
[i]
any injury to person or property caused by any products sold or otherwise distributed in connection with the Mono Industries server;
[ii]
any material supplied by the
Customer infringing or allegedly infringing on the proprietary rights of a third party;
[iii] copyright infringement;
[vi]
any defective products sold to
the Customer from the Mono Industries server.
Disclaimer
1. Mono Industries will not be responsible for any damages your business may suffer resulting from Services provided by Mono Industries. Mono Industries make no warranties of any kind, expressed or implied for Services that we provide. Mono Industries disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Mono Industries and its employees or contractors. Mono Industries’ financial liability is restricted to the price paid for the service provided. Mono Industries reserve the right to revise its policies at any time.
Governing law
1. This Agreement shall be governed and construed in accordance with the laws of England, Scotland, Wales and Northern Ireland and the parties irrevocably agree to the exclusive jurisdiction of the courts of England, Scotland, Wales and Northern Ireland.
2. If any clause of these Terms and Conditions is held to be unenforcable in whole or in part, the other terms and the rest of the provisions shall continue to be valid and enforceable. By paying your annual hosting fee, you are agreeing to be bound by these Terms & Conditions.
